PRESS STATEMENT THE NATIONAL UNION OF BANK EMPLOYEES (NUBE) WILL BE CARRYING OUT A NATIONAL PICKET THROUGHOUT PENINSULAR MALAYSIA TO OBJECT AGAINST THE INJUSTICE, DISCRIMINATION AND APPALING DISREGARD FOR HARMONIOUS INDUSTRIAL RELATIONS BY HSBC BANK MALAYSIA, INVOLVING 300 TRADE DISPUTES
The National Union of Bank Employees (NUBE) will be carrying out a nationwide picket throughout Peninsular Malaysia as a sign of protest against the injustice, and unprincipled and discriminatory practices by HSBC Bank Malaysia Berhad, which involving 300 trade disputes.
NUBE has been made to take up this industrial relations trade dispute after the former and current HSBC Bank Malaysia CEO failed to conduct/effect the Standing Committee Meeting to resolve the Dispute Settlement process, as stipulated under the Collective Agreement. Not only have the HSBC Bank Malaysia Management refused to resolve the issues raised by NUBE during the past three (3) years, they have continued to violate the rights and interests of the NUBE members, who comprise the B40 and M40 categories.
Among others the trade disputes includes the following:
i. Failure and refusal by HSBC Bank Malaysia to comply with the Malaysian labour laws including the Industrial Relations Act 1967
ii. HSBC Bank Malaysia insults Islam
iii. HSBC Bank Malaysia discriminates against bank workers, who are largely NUBE members
iv. HSBC Bank Malaysia breaches labour laws by interfering and attempting to control NUBE’s roles and functions as a trade union
v. HSBC Bank Malaysia discovered to have revealed private information of customers to unknown parties, therefore violating Section 30 & 40 of the Personal Data Protection Act 2010
vi. HSBC Bank Malaysia’s violation of Section 133 (1) of the Financial Services Act 2013
vii. Legitimate grievances raised by workers and NUBE ignored by HSBC Bank Malaysia
viii. HSBC Bank Malaysia management having invited workers for meetings, forbids them from entering the meeting premises
ix. Outsourcing work to third parties and not only forcing NUBE members to accept lay off, but also forcing members to submit new application for jobs within the bank
x. HSBC Bank Malaysia treats its workers as criminals
NUBE is left with no other options besides carrying out this picket, since HSBC Bank Malaysia has repeatedly refused to negotiate with NUBE, at every stage, to promote a harmonious industrial relations, as provided under the provisions in the two Collective Agreements and the Industrial Relations Act 1967. HSBC Bank Malaysia has also deliberately been avoiding consultations with NUBE to find a solution towards all the complaints that have been raised against HSBC Bank Malaysia.
This exploitative attitude by HSBC Bank Malaysia, involving 300 trade disputes during the pandemic, is aimed at continuously testing the patience of the B40 and M40 workers. Such an extreme attitude does not reflect their status as a global bank.
Following the above unresolved grievances, NUBE would be carrying out their nationwide picket, which will be starting in Johor Bahru, Johor on 10 Mac 2022, being this Thursday, commencing from 1.30 pm to 2.30 pm. The first picket shall take place at HSBC Jalan Bukit Timbalan, Johor Bahru.
